1. Agreement to Terms

By accessing, browsing, or using the Christopher Josiah Clothing Shop website at https://christopherjosiah.com (the "Site"), operated by Christopher Josiah Clothing Shop ("we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

These Terms apply to all visitors, users, and customers of the Site. If you do not agree to these Terms, you must not access or use the Site.

These Terms are supplemented by our Privacy Policy and Cookie Policy, which are incorporated herein by reference.

We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to the Site. The "Last Updated" date at the top will be revised accordingly.

Your continued use of the Site after any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

By using this Site, you represent and warrant that:

  • If you are between 13 and 18 years of age, you have obtained parental or guardian consent to use the Site and agree to these Terms
  • You have the legal capacity to enter into a binding agreement in your jurisdiction
  • You are not prohibited from using the Site under any applicable law

If you are making a purchase, you must be at least 18 years of age or have the express permission of a parent or legal guardian.

4. Products and Orders

a. Product Descriptions

We strive to display our luxury clothing products as accurately as possible. However:

  • Colors may vary slightly due to monitor, screen, and lighting conditions
  • Measurements are approximate and may vary slightly between individual garments
  • Product images may show styling, accessories, or props that are not included with the product unless explicitly stated
  • We reserve the right to update product descriptions, images, and specifications at any time

b. Pricing

  • All prices are listed in Philippine Peso (PHP ₱) unless otherwise indicated
  • Prices are subject to change without notice
  • We reserve the right to correct any pricing errors, even after an order has been placed
  • Prices do not include applicable taxes, shipping fees, customs duties, or import fees unless explicitly stated
  • International customers (USA, ASEAN outside the Philippines, and Europe) may be subject to customs duties, import taxes, VAT, and fees imposed by their country. These charges are the sole responsibility of the customer

c. Placing an Order

  • Placing an order constitutes an offer to purchase the product(s)
  • We reserve the right to accept or decline any order for any reason, including but not limited to:
    • Product unavailability or stock errors
    • Pricing errors
    • Suspected fraudulent activity
    • Errors in product or order information
    • Inability to verify payment
  • An order confirmation email does not constitute final acceptance of your order. Acceptance occurs when the product has been prepared for shipment and you receive a shipping confirmation
  • We reserve the right to limit quantities per customer

d. Payment

Payment is due in full at the time of purchase. We accept the following payment methods:

  • GCash — for Philippine Peso (PHP) transactions
  • Bank Transfer — for Philippine Peso (PHP) transactions (bank details will be provided upon checkout)
  • Wise — for international payments via our Wise Tag (for customers outside the Philippines)

Important payment notes:

  • Orders will only be processed and fulfilled after payment has been confirmed
  • For Bank Transfer and GCash payments, please send your proof of payment to christopherjosiahwork@gmail.com along with your order number
  • For Wise international payments, please allow additional processing time for currency conversion
  • We are not responsible for transaction fees, exchange rate differences, or transfer delays imposed by GCash, your bank, or Wise
  • You represent and warrant that you are authorized to use the payment method provided

e. Order Processing Time

  • Orders are typically processed within [X] business days after payment is confirmed
  • Processing time does not include shipping time
  • During peak seasons, sales, or new collection launches, processing times may be longer. We will notify you if there are significant delays

f. Order Cancellation

  • You may request to cancel an order by contacting us at christopherjosiahwork@gmail.com beforethe order has been shipped
  • Once an order has been shipped, it cannot be canceled but may be eligible for return under our Return Policy (see Section 5)
  • We reserve the right to cancel any order at our discretion and will provide a full refund if we do so

5. Shipping and Delivery

a. Shipping Destinations

We currently ship to the following regions:

  • ASEAN (Southeast Asia)
  • United States of America (USA)
  • Europe

We do not currently ship to regions not listed above. If you are unsure whether we ship to your location, please contact us at christopherjosiahwork@gmail.com before placing an order.

b. Estimated Delivery Timeframes

Please note that delivery timeframes are estimates only and are not guaranteed:

Region Estimated Delivery Time
ASEAN (Southeast Asia) 3 to 4 weeks from shipment date
United States of America 4 to 5 weeks from shipment date
Europe 4 to 5 weeks from shipment date

These timeframes begin from the date your order is shipped, not the date your order is placed. Processing time is separate from shipping time.

c. Shipping Delays

We are not responsible for delays caused by:

  • Shipping carriers or courier services
  • Customs and border protection processing
  • Weather conditions, natural disasters, or other acts of God
  • Public holidays in the origin or destination country
  • Incomplete or incorrect shipping address provided by the customer
  • Any other events beyond our reasonable control

d. Shipping Rates

Shipping rates are calculated at checkout based on your location and order details. All applicable shipping fees will be displayed before you complete your purchase.

e. Tracking

Once your order has been shipped, you will receive a shipping confirmation email with available tracking information. It is your responsibility to monitor your shipment and be available for delivery.

f. Risk of Loss

Title and risk of loss for products pass to you upon delivery to the shipping carrier. We are not responsible for packages that are lost, stolen, or damaged during transit. If your package is lost or significantly delayed, please contact us and we will work with the carrier to investigate.

g. International Orders — Customs and Duties

  • International customers (USA, ASEAN outside the Philippines, Europe) are solely responsible for all customs duties, import taxes, VAT, and any additional fees imposed by their country's customs authority
  • We are not responsible for delays caused by customs processing
  • We do not falsify customs declarations or mark packages as "gifts" to circumvent customs duties
  • If a package is refused or returned due to unpaid customs fees, the customer will be responsible for the cost of return shipping and any associated fees

h. Incorrect Address

  • It is the customer's responsibility to provide a complete and accurate shipping address at checkout
  • We are not responsible for orders shipped to an incorrect address provided by the customer
  • If you realize you have entered an incorrect address, please contact us immediately at christopherjosiahwork@gmail.com. We will do our best to correct the address if the order has not yet been shipped

6. Returns, Exchanges, and Refunds

We want you to be completely satisfied with your Christopher Josiah Clothing Shop purchase. Please read our return policy carefully before making a purchase.

a. Eligibility for Returns

We accept returns within 14 days of the confirmed delivery date, subject to the following conditions:

Items are eligible for return if they are:

  • Unworn, unwashed, and in their original condition
  • Free from odors, stains, pet hair, or any signs of use
  • With all original tags still attached
  • In original packaging where applicable

Items that are NOT eligible for return include:

  • Sale or discounted items — all sale items are Final Sale and cannot be returned or exchanged
  • Items that have been worn, washed, or altered
  • Items without original tags
  • Items that show signs of wear, damage, or misuse
  • Items returned outside of the 14-day return window
  • Custom or made-to-order items (if applicable)

b. Who Pays for Return Shipping?

  • Customer-paid returns: The customer is responsible for all return shipping costs for returns due to change of mind, sizing issues, or any reason other than our error
  • Christopher Josiah Clothing Shop-paid returns: We will cover the cost of return shipping only in cases where:
    • The item received is damaged or defective upon arrival
    • The wrong item was sent due to our error

c. How to Initiate a Return

  1. Contact us at christopherjosiahwork@gmail.com within 14 days of delivery with:
    • Your order number
    • The item(s) you wish to return
    • The reason for the return
    • Photos of the item(s) (required for damaged or defective claims)
  2. Wait for our response and return authorization. Do not ship items back without authorization
  3. Ship the item(s) back using a trackable shipping method
  4. Send us the tracking information once shipped

We are not responsible for return packages that are lost or damaged in transit.

d. Refunds

  • Once we receive and inspect the returned item(s), we will notify you of the approval or rejection of your refund
  • Approved refunds will be processed within 5 to 10 business days of receiving the returned item
  • Refunds will be issued through the original payment method (GCash, Bank Transfer, or Wise)
  • Original shipping charges are non-refundable unless the return is due to our error
  • Depending on your payment method and financial institution, it may take additional time for the refund to be reflected

e. Exchanges

  • We offer exchanges for a different size or color of the same item, subject to availability
  • To request an exchange, please contact us at christopherjosiahwork@gmail.com within 14 days of delivery
  • If the desired item is not available, we will issue a refund instead
  • Exchange shipping costs are the customer's responsibility

f. Damaged or Defective Items

If you receive a damaged or defective item:

  1. Contact us at christopherjosiahwork@gmail.com within 7 days of delivery
  2. Include:
    • Your order number
    • Clear photos of the damaged or defective item
    • A description of the issue
  3. We will review your claim and offer a replacement or full refund at our discretion
  4. We will cover the cost of return shipping for confirmed damaged or defective items

g. Philippine Consumer Protection

As a business operating under Philippine law, we comply with the Consumer Act of the Philippines (Republic Act No. 7394). In accordance with this law:

  • If an item is found to be defective, we are obligated to offer repair, replacement, or refund regardless of any other policy stated herein
  • Your statutory rights under Philippine consumer protection law are not affected by our return policy

7. Intellectual Property

a. Our Content

All content on the Site, including but not limited to:

  • Text, articles, and product descriptions
  • Photographs, images, and graphics
  • Logos, brand names, and trademarks including "Christopher Josiah" and "Christopher Josiah Clothing Shop"
  • Website design, layout, and visual elements
  • Videos and multimedia content

is the property of Christopher Josiah Clothing Shop or its licensors and is protected by copyright, trademark, and other intellectual property laws in the Philippines and worldwide.

b. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. This license does not include:

  • Modifying, copying, or reproducing Site content
  • Using content for commercial purposes without written permission
  • Downloading, scraping, or data mining

10. Disclaimers

a. "As Is" and "As Available"

THE SITE, INCLUDING ALL CONTENT, PRODUCTS, AND SERVICES, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

b. No Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE PHILIPPINE LAW AND THE LAWS OF OTHER APPLICABLE JURISDICTIONS, CHRISTOPHER JOSIAH CLOTHING SHOP DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE SITE

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

CHRISTOPHER JOSIAH CLOTHING SHOP, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or income
  • Loss of data or information
  • Loss of business or goodwill
  • Any other intangible losses

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • The total amount you paid to Christopher Josiah Clothing Shop for the specific order giving rise to the claim, or
  • Five Hundred Philippine Pesos (PHP ₱500.00)

NOTHING IN THESE TERMS LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER PHILIPPINE LAW OR OTHER APPLICABLE LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Christopher Josiah Clothing Shop, its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Site or any products purchased through the Site
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any third-party rights
  • Any content you submit through the Site
  • Any fraudulent or unauthorized payment made through your account or device

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms that is not subject to arbitration under Section 14 shall be brought exclusively in the appropriate courts of Manila, Philippines, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

a. Informal Resolution

Before filing any formal legal claim, you agree to first contact us at christopherjosiahwork@gmail.comand attempt to resolve the dispute informally. Please describe the nature of your complaint and the resolution you are seeking. We will endeavor to resolve the dispute within thirty (30) days of receiving your notice.

b. Binding Arbitration

If the dispute cannot be resolved informally within thirty (30) days, you and Christopher Josiah Clothing Shop agree to resolve any claims relating to these Terms or your use of the Site through final and binding arbitration, rather than in court, with the following terms:

  • Arbitration shall be conducted in accordance with the Alternative Dispute Resolution Act of 2004 (Republic Act No. 9285) of the Philippines
  • Arbitration shall be administered by a mutually agreed-upon arbitrator or arbitration body
  • Arbitration may be conducted online or remotely to accommodate international customers
  • The arbitration shall be conducted in the English language
  • The arbitrator's decision shall be final and binding on both parties
  • Judgment on the arbitration award may be entered in any court of competent jurisdiction
  • Costs of arbitration shall be shared equally between the parties unless the arbitrator determines otherwise

c. Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND CHRISTOPHER JOSIAH CLOTHING SHOP AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Christopher Josiah Clothing Shop.

d. Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to:

  • Protect intellectual property rights
  • Prevent irreparable harm pending arbitration
  • Enforce an arbitration award

Customers also retain the right to file complaints with relevant consumer protection authorities, including the Philippine Department of Trade and Industry (DTI) and their local consumer protection agencies.

e. Opt-Out Right

If you do not wish to be bound by the arbitration clause, you may opt out by sending written notice to christopherjosiahwork@gmail.com within thirty (30) days of first agreeing to these Terms. Your opt-out notice must include your name, the email address used for your order, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provisions of these Terms.

15. Severability

If any provision of these Terms is found by a court or arbitrator to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Waiver

The failure of Christopher Josiah Clothing Shop to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and acknowledged by an authorized representative of Christopher Josiah Clothing Shop.

17. Force Majeure

Christopher Josiah Clothing Shop shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to:

  • Natural disasters, typhoons, earthquakes, or other acts of God
  • Epidemics, pandemics, or public health emergencies
  • War, terrorism, or civil unrest
  • Government actions, sanctions, or travel restrictions
  • Supply chain or manufacturing disruptions
  • Power or internet outages
  • Shipping carrier delays or failures
  • Customs processing delays
  • Strikes or labor disputes

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Christopher Josiah Clothing Shop regarding your use of the Site and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
